For example, for a level one DWI, a minimum sentence is 30 days. Consequences may also include community service, fines, alcohol assessment and follow through with recommended treatment. The consequences you may face in your situation depend on many factors. Prosecutors and judges may consider prior DWIs. They may also consider your blood alcohol content (BAC) at the time of the incident. In North Carolina, BAC for driving while intoxicated is .08, and higher levels may affect your case negatively.
